Performance, geotechnical and systemic risks - Ground engineering case studies.

This paper deals with the legal framework of the relationship between contractor (AN) and client (AG) with respect to the allocation of certain construction risks. It focuses on the risk of successful performance of the contractor as a result of service contracts as well as geotechnical and systemic risks. After the legal and practical definition of these risks, six ground engineering case studies are presented that range from straightforward to complex cases including variant design solutions and transfer of risk allocation. After that court rulings are presented to give insights into judicial practice.
