Abstrait:

The main scope of this article is to expose an effective methodology for the investigation in complex accidents that they have happened by structural complex failures, in temporary work equipment that has been used during the building on different construction sites. This methodology is based on real cases, and due to its application and development it has allowed the determination of the technical causes that has induced the mechanism for structural collapsed with the scientific severity that it is necessary in a performance of these characteristics. Accurately by the complexity that it motivates the determination of the technical causes in singular structural failures, as well as the judicial process derived from a serious accident. It is very important that it takes into account the methodology and aspects that it has to comply for what the expert report adapts to the scope and expected expectations, basically so that expert report has the scientific rigor that it allows to demonstrate by unquestioned form the technical causes that has induced the failure. Some main aspects it must to take into account during all the process and for the making of expert report, like; visiting the accident area getting the broken pieces and rest of pieces belonging temporary work equipment or installation; permanent identification and traceability during the manipulation and tests carried out on the recovered pieces, independently of the nature, destructive or not; application of the analytical and experimental assessment methods for understanding the safety conditions of the damaged equipment, previously and in the moment of the accident, finally, an expert report writing in a simple language that allows to the different agents (judge, prosecutor, lawyer, accused) involved on the judicial process, to understand clearly how the mechanism of failure has occurred despite that they have not a technical knowledge about the topic.
